Stay Near does not own, inspect, manage, guarantee, or warrant any listed property unless expressly stated.
Listings & Rental Operator Responsibilities
Rental operators (hosts) are solely responsible for the accuracy, safety, condition, legality, and availability of their properties, including bookings, cancellations, payments, refunds, taxes, permits, insurance, and guest disputes. Stay Near is not a party to any rental agreement between a guest and a rental operator.
Listing content — including photos, descriptions, pricing, availability, and amenities — is submitted by rental operators. Stay Near does not independently verify this content and makes no representations about its accuracy or completeness.
Experiences, Attractions & Travel Information
Information about experiences, attractions, events, theme parks, trails, waterfalls, scenic drives, festivals, and regional content is provided for general informational purposes. Dates, hours, access, pricing, parking, tickets, closures, weather, safety conditions, and availability may change without notice.
You are responsible for verifying details before travel. Plan ahead, check official sources, and assess safety conditions (including water levels, trail conditions, weather, and road access) before visiting any location.
Third-Party Links & Services
Stay Near links to third-party booking platforms, rental operator websites, attraction sites, event organizers, and informational resources. Stay Near is not responsible for the content, policies, availability, or practices of any third party. Your interactions with third parties are solely between you and that party.
User-Submitted Content
By submitting content (including listings, photos, descriptions, reviews, or messages), you represent that you have the right to do so and grant Stay Near a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and distribute that content in connection with operating and promoting the platform. You are solely responsible for content you submit.
Acceptable Use
- Do not submit false, misleading, infringing, or unlawful content.
- Do not interfere with or attempt to disrupt the platform.
- Do not scrape, harvest, or copy site content without permission.
- Do not use the platform to harass, defraud, or harm others.
Data, Content & Intellectual Property
All curated content on Stay Near — including the selection, organization, descriptions, photography captions, ratings, categorizations, regional groupings, scoring, and editorial guidance for experiences, attractions, events, waterfalls, scenic drives, regions, and stays — is the intellectual property of StayNearItAll LLC and protected under U.S. and international copyright, database, and unfair competition laws. The compilation itself is a protectable database under the "sweat of the brow" / collective work doctrine, regardless of whether individual facts are protectable.
You may not, without our prior written permission:
- Scrape, crawl, mirror, or systematically download any portion of the site, whether by automated tool, headless browser, script, AI agent, or manual bulk extraction.
- Use Stay Near content to train, fine-tune, evaluate, or retrieve-augment any machine-learning model, large language model, embeddings index, or generative AI system. This expressly withdraws any implied license for AI training under U.S. and EU law (including the EU Directive 2019/790 Article 4(3) reservation of rights).
- Republish, redistribute, or resell curated lists, descriptions, recommendations, or regional groupings, in whole or substantial part, on any other website, app, dataset, or service.
- Remove, obscure, or alter any copyright, trademark, or attribution notice.

TO THE FULLEST EXTENT PERMITTED BY LAW, STAY NEAR AND STAYNEARITALL LLC, INCLUDING THEIR OFFICERS, MEMBERS, EMPLOYEES, AND AFFILIATES, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, ANY LISTING, ANY RENTAL OPERATOR, OR ANY EXPERIENCE OR ATTRACTION, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
Indemnification
You agree to indemnify and hold harmless Stay Near and StayNearItAll LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the platform, your content, or your violation of these Terms.
Privacy
Your use of Stay Near is also governed by our Privacy Policy.
Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the platform will be resolved exclusively in the state or federal courts located in Georgia, and you consent to the jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.
